Your California Privacy Rights: Opt Out of Sale or Sharing
If you are a California resident, you have the right under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) to opt out of the sale or sharing of your personal information by PromiseCare Medical Group.
What “Sale” and “Sharing” Mean Under California Law
“Sale” means providing your personal information to a third party in exchange for money or other valuable consideration.
“Sharing” means providing your personal information to a third party for cross-context behavioral advertising — meaning advertising targeted to you based on your activity across different websites, apps, or services — regardless of whether money is exchanged.
Important: HIPAA-Covered Health Information Is Handled Separately
PromiseCare Medical Group is a HIPAA-covered entity. Protected Health Information (PHI) — individually identifiable information relating to your health, healthcare services, or healthcare payments — is governed by HIPAA and is expressly exempt from CCPA/CPRA. PromiseCare does not sell your PHI. PHI is used and disclosed only as permitted under HIPAA and as described in our HIPAA Notice of Privacy Practices.
The opt-out right described on this page applies to non-PHI personal information collected through our public-facing websites, such as contact information, newsletter subscription data, and website analytics data.
What Personal Information May Be Sold or Shared
To the extent that PromiseCare’s use of third-party analytics tools (such as Google Analytics) or advertising technologies constitutes a “sale” or “sharing” of personal information under California law, the following categories of non-PHI personal information may be involved:
- Identifiers — IP address, browser/device identifiers, online identifiers associated with analytics cookies
- Internet or network activity — Pages visited, time on pages, referral source, interaction with Site features
PromiseCare does not sell or share your name, mailing address, phone number, or email address to third-party data brokers or unaffiliated marketers.
How to Opt Out
You may opt out of the sale or sharing of your personal information using any of the following methods:
Option 1 — Submit a Request Online
Complete the form below (or use our contact form at promisecare.com/contact-us/) and select “Do Not Sell or Share My Personal Information” as the reason for contact:
To submit your opt-out request online, please use our Contact Us form and select “Do Not Sell or Share My Personal Information” as the subject of your inquiry.
Option 2 — Email
Send an email to contact@promisecare.com with the subject line: “Do Not Sell or Share — California Opt-Out”. Include your name and the email address or contact information associated with your PromiseCare account or newsletter subscription.
Option 3 — Phone
Call us at (951) 390-2840 (TTY: 711), Monday – Friday, 8:00 AM – 5:00 PM, and ask to submit a “Do Not Sell or Share” request.
Option 4 — Global Privacy Control (GPC)
If your browser or browser extension transmits a Global Privacy Control (GPC) signal when you visit our Sites, PromiseCare will automatically treat that signal as a valid opt-out of the sale or sharing of your personal information, as required by CPRA § 1798.135(d).
How We Process Your Request
Once we receive your verifiable opt-out request, we will:
- Process your request within 15 business days
- Stop selling or sharing the applicable categories of your personal information
- Notify all third parties to whom we have sold or shared your personal information in the 90 days prior to your request, directing them not to further sell or share that information
We will confirm receipt of your request and notify you when it has been fulfilled.
You Will Not Be Discriminated Against
Exercising your right to opt out of the sale or sharing of your personal information will not result in:
- Denial of goods or services
- Different prices or rates
- A different level or quality of services
- Any other discriminatory treatment
You are entitled to the same quality of care and services from PromiseCare regardless of whether you exercise this right.
Authorized Agents
If you are submitting an opt-out request on behalf of a California resident, you must provide written documentation of your authorization to act on that person’s behalf. PromiseCare may contact the individual to verify the request.
Re-Opting In
If you opt out and later wish to opt back in to allowing the sale or sharing of your personal information, you may do so by contacting us at contact@promisecare.com or (951) 390-2840. We will begin processing your opt-in within 15 business days.
Additional California Privacy Rights
California residents have additional rights beyond the right to opt out, including the right to know, the right to delete, the right to correct, and the right to limit the use of sensitive personal information.
